1. Acceptance of Terms
By accessing or using the I Magic C mobile application ("App") and related services provided by Sino BiofiberSuger Limited ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and the Company.
If you do not agree to these Terms, do not download, install, access, or use the App.
3. Service Description
I Magic C is an AI-powered photo editing application that allows users to take or upload photos and preview hairstyle changes using artificial intelligence. Our services may include:
- AI-powered hairstyle transformation from photos
- Multiple hairstyle styles and options to try
- Photo capture and import capabilities
- High-quality image processing
- Style recommendations based on user preferences
- Paid premium features unlocked through Diamonds
4. User Eligibility and Age Restriction
You may use the App only if you meet all of the following requirements:
- You are at least 18 years old.
- You have the legal capacity to enter into a binding agreement.
- You are not prohibited by applicable law from using the App or related services.
- You will use the App only in compliance with these Terms and applicable laws.
Age Restriction: The App is not intended for users under 18. If you are under 18, you must not use the App or submit photos, personal information, or payment information through the App.
5. User Accounts
5.1 Account Creation
You may need to create an account to access certain App features. You agree to provide accurate, current, and complete information and to keep your account information updated.
5.2 Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You must notify us promptly if you suspect unauthorized access, account misuse, or any security issue.
6. User Content and Photo Processing
You retain ownership of photos and other content you upload, capture, or submit through the App ("User Content"). By using the App, you grant us a limited right to process User Content solely as necessary to provide, maintain, protect, and improve the App and related AI photo editing services.
You represent that you have all necessary rights and permissions to upload or process any photo or content submitted through the App, including permission from any person appearing in the photo where required by applicable law.
7. Intellectual Property
The App, software, AI models, interfaces, designs, graphics, logos, text, trademarks, service marks, databases, workflows, and other materials provided by us are owned by the Company or its licensors and are protected by intellectual property and other laws.
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use the App for personal, lawful, and non-commercial purposes.
You must not copy, modify, translate, adapt, distribute, sell, lease, sublicense, reverse engineer, decompile, attempt to extract source code from, or create derivative works based on the App or any part of our technology, except to the extent such restriction is prohibited by applicable law.
8. Payment Terms
8.1 Diamond Purchases
I Magic C offers virtual currency in the form of "Diamonds" to unlock premium features and AI photo editing services. The App currently offers Diamond purchase packages based on the exchange rate of 100 Diamonds per $1 USD ($1 USD = 100 Diamonds). Bonus diamonds may be included when purchasing larger packages.
8.2 Final Purchases
All Diamond purchases are one-time purchases and are final, except where refunds are required by applicable law or the applicable app store policy. The App does not currently offer any auto-renewing subscription plans.
8.3 App Store Billing
All purchases are processed through the official app store payment mechanism. Billing, refunds, chargebacks, and payment method issues may be subject to the rules of the applicable app store or payment provider.
9. User Conduct and Prohibited Activities
You agree to use I Magic C responsibly and legally. Prohibited activities include:
- Using the App for any illegal, fraudulent, misleading, abusive, harmful, or unauthorized purpose.
- Reselling, renting, leasing, sublicensing, distributing, or commercially exploiting the App, Diamonds, account access, generated results, or any App feature without our written permission.
- Committing payment fraud, refund abuse, chargeback abuse, account sharing abuse, or other dishonest conduct.
- Uploading photos or content that you do not have the right to use, or that infringes privacy, publicity, intellectual property, or other rights.
- Uploading unlawful, defamatory, harassing, hateful, sexually exploitative, violent, or otherwise harmful content.
- Impersonating another person, misrepresenting your identity, or submitting false account or billing information.
- Using bots, scripts, scraping, automated access, or other non-human means to access or abuse the App.
- Interfering with, disrupting, overloading, damaging, or attempting to gain unauthorized access to the App, our systems, or other users' accounts.
- Bypassing usage limits, security controls, payment controls, or technical protection measures.
- Using the App to train, benchmark, copy, or extract AI models, datasets, or proprietary technology without authorization.
10. Beauty, Health, and Allergy Disclaimer
The App provides digital hairstyle previews and photo editing results for reference and entertainment purposes only. The App does not provide medical, dermatological, cosmetic, hair treatment, or other professional advice.
Generated hairstyle, hair color, or appearance previews may differ from real-world results. Any real-world haircut, dye, chemical treatment, cosmetic product, accessory, or third-party beauty service you choose is your own decision and responsibility.
To the maximum extent permitted by applicable law, we are not responsible for allergic reactions, skin irritation, hair damage, dissatisfaction with real-world results, personal injury, property damage, or other losses arising from products, treatments, salons, stylists, or third-party services selected or used outside the App.
11. Termination and Suspension
11.1 Termination by User
You may stop using the App at any time. You may request account deletion through the App settings or by contacting us.
11.2 Suspension or Termination by Company
We may suspend or terminate your access to the App, remove content, limit features, or take other reasonable action if we believe you have violated these Terms, created legal risk, engaged in fraud or abuse, or harmed the App, the Company, or other users.
11.3 Effect of Termination
Upon termination, your right to use the App ceases immediately. Sections that by their nature should survive termination, including intellectual property, payment obligations, disclaimers, limitation of liability, governing law, and dispute provisions, will continue to apply.
12. Disclaimer of Warranties
The App and related services are provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, security, and non-infringement.
We do not guarantee that the App will be uninterrupted, error-free, secure, compatible with every device, or that AI-generated results will be accurate, complete, suitable for your purpose, or free from defects.
13. Limitation of Liability
To the maximum extent permitted by applicable law, the Company and its directors, officers, employees, contractors, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or similar damages, including loss of profits, loss of data, loss of goodwill, service interruption, or device damage arising from or related to your use of the App.
To the maximum extent permitted by applicable law, our total liability for any claim arising from or related to the App or these Terms will not exceed the amount you paid to us for the App services in the three months before the event giving rise to the claim.
Nothing in these Terms limits liability that cannot be limited or excluded under applicable law.
14. Privacy
Our collection and use of personal information is described in our Privacy Policy. By using the App, you acknowledge that photos, account information, purchase information, device data, and other information may be processed as described in the Privacy Policy.
15. Changes to These Terms
We may update these Terms from time to time. We will provide notice of material changes through the App, by posting the updated Terms, or by other reasonable means where required by applicable law.
Your continued use of the App after updated Terms take effect means you accept the updated Terms. If you do not agree to the updated Terms, you must stop using the App.
16. Governing Law and Dispute Resolution
16.1 Governing Law
These Terms and any dispute or claim arising from or related to the App, the services, or these Terms are governed by the laws of Hong Kong, without regard to conflict of law principles, unless mandatory laws in your place of residence provide otherwise.
16.2 Jurisdiction
You agree that courts located in Hong Kong will have jurisdiction over disputes arising from or related to these Terms, except where applicable consumer protection laws give you the right to bring claims in another jurisdiction.
16.3 Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
